These Terms of Use ("Terms") form an agreement between you and Super Business Tools ("we", "our", "us") regarding your use of the Caff iOS application ("Caff", the "App"). By installing or using Caff, you agree to these Terms. If you do not agree, please do not install or use the App.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Caff on Apple-branded devices that you own or control, in accordance with the Usage Rules in the Apple App Store Terms of Service. You may not copy, modify, decompile, reverse-engineer, sublicense, rent, lease, or sell the App, except to the extent permitted by applicable law.
Caff is a reading tool that presents text you provide one word at a time. It is offered to help you read more quickly and comfortably, but:
Choose a speed that keeps the material readable for you, and do not rely on Caff where misreading could cause harm.
You are responsible for the text and files you import into Caff. You agree that you have the right to read and store that material, and that doing so does not infringe anyone's copyright or other rights. Caff is for your own personal reading; it does not grant you any rights in third-party content, and importing an article or book does not change who owns it.
You agree to use Caff only for lawful, personal purposes. You will not interfere with or disrupt the App, attempt to circumvent its security or licensing mechanisms, or use it to facilitate any illegal activity.
Our handling of information is described in the Caff Privacy Policy, which is incorporated into these Terms by reference.
Caff is a one-time purchase distributed exclusively through the Apple App Store. Any payments, restorations, family-sharing arrangements, and refunds are handled by Apple under its own terms. We do not process payments directly and cannot issue refunds on Apple's behalf.
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected.
To the maximum extent permitted by applicable law, Super Business Tools shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, Caff. Our total cumulative liability for any claim arising out of these Terms or the App shall not exceed the amount you paid for the App in the twelve months prior to the event giving rise to the claim, or USD 10, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
You acknowledge that these Terms are between you and Super Business Tools, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
You may stop using Caff at any time by deleting it from your device. We may suspend or terminate your license if you materially breach these Terms. Sections that by their nature should survive termination (including the disclaimers, limitation of liability, and governing law) will survive.
We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you in-app. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the jurisdiction in which Super Business Tools is established, without regard to its conflict-of-laws principles. Any disputes will be resolved in the competent courts of that jurisdiction, except where applicable consumer-protection law gives you the right to bring proceedings in your own country.
